By accessing or using Cadencify's email sequencing platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Cadencify is a micro-SaaS platform that enables users to:

• Create and schedule personalized email sequences
• Integrate with Gmail and Outlook via OAuth
• Track email delivery, opens, and engagement
• Manage contacts and email campaigns
• Utilize AI-powered features through Google's Gemini API for content generation and enhancement

3. User Accounts

To use our Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

4. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited emails, or violate anti-spam laws
• Engage in illegal activities or violate applicable laws
• Harass, abuse, or harm other users
• Distribute malware, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Use the Service for any fraudulent purposes
• Submit inappropriate, harmful, or illegal content to AI features
• Attempt to exploit or misuse AI services for generating harmful content

5. AI Services and Third-Party Processing

Our platform integrates with Google's Gemini API to provide AI-powered features. By using these features, you acknowledge and agree that:

• Your prompts and inputs may be processed by Google's AI systems
• Google may use these interactions to improve their AI models and services
• You are responsible for ensuring your inputs comply with both our Terms and Google's policies
• AI-generated content should be reviewed before use and may not always be accurate
• You retain ownership of your original inputs while generated outputs are subject to applicable terms

Important Distinction: Data obtained through Google Workspace APIs (Gmail integration) is NOT used to develop, improve, or train generalized AI and/or ML models. This policy applies only to data submitted through our AI-specific features powered by the Gemini API.

6. Email Compliance

Users must comply with all applicable email marketing laws, including but not limited to:

• CAN-SPAM Act (United States)
• GDPR (European Union)
• CASL (Canada)
• Obtaining proper consent before sending emails
• Providing clear unsubscribe mechanisms

7. Payment Terms & Credits

Cadencify uses "Credits" as its in-app currency. Credits are consumed when using various features and services within our platform, including but not limited to email sending, AI-powered content generation, and other premium features as they become available.

• Credits are purchased in advance through RazorPay and debited as platform features are used
• Different features may consume different amounts of credits as specified in the platform interface
• Current credit consumption rates are displayed on our pricing page and within the application
• All credit purchases are processed securely through RazorPay's payment gateway
• All credit purchases are non-refundable unless required by law
• We reserve the right to modify credit pricing and consumption rates at our sole discretion
• Access to premium features will be restricted when credit balance is insufficient until additional credits are purchased
• Credits do not expire and remain in your account indefinitely

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Cadencify and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or suspend the Service as needed.

10. Limitation of Liability

To the maximum extent permitted by law, Cadencify shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify, update, or replace these Terms and Conditions at any time without prior notice. Changes may include but are not limited to updates to our pricing, credit policies, acceptable use guidelines, or any other provisions contained herein.

Any changes will be posted on this page with an updated effective date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms and Conditions. It is your responsibility to review these Terms periodically for changes.
